1. Commitment to Copyright Compliance

Digital Ad Archive, LLC (“Digital Ad Archive,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act of 1998 (“DMCA”), including its notice and takedown procedures set forth in 17 U.S.C. § 512.

Digital Ad Archive is a research and educational platform that preserves historically significant vintage print advertisements and enriches them with AI-generated metadata to facilitate academic research, cultural study, education, criticism, and commentary. We believe our use of these materials constitutes fair use under 17 U.S.C. § 107; however, we take all copyright claims seriously and will respond promptly to valid takedown notices.

2. Fair Use Statement

Digital Ad Archive’s mission is the preservation, indexing, and scholarly study of vintage print advertising as cultural artifacts. Our use of copyrighted materials is transformative in nature:

• Purpose and character of use: We do not republish advertisements for their original commercial purpose. Instead, we apply artificial intelligence to extract structured metadata (brand identification, historical context, visual analysis, cultural sentiment, and 100+ other data fields) that transforms each advertisement into a searchable research record.
• Nature of the copyrighted work: The advertisements in our archive are published commercial works, many decades old, created for mass public distribution.
• Amount and substantiality: Images are displayed at reduced resolutions appropriate for identification and research purposes, not at print-ready quality suitable for commercial reproduction.
• Effect on the market: Our platform does not compete with or substitute for the original commercial purpose of these advertisements. The original advertising campaigns concluded decades ago and are no longer actively marketed. Our use creates an entirely new market — AI-powered research and cultural analysis — that does not diminish any existing or potential market for the original works.

Notwithstanding this fair use position, we honor valid DMCA takedown requests from copyright holders or their authorized agents.

3. Designated DMCA Agent

Our designated agent for receiving notifications of claimed copyright infringement is:

4. Filing a DMCA Takedown Notice

If you are a copyright owner (or authorized to act on behalf of one) and believe that material on Digital Ad Archive infringes your copyright, you may submit a written takedown notice to our Designated Agent. Your notice must include allof the following (per 17 U.S.C. § 512(c)(3)):

1. Identification of the copyrighted work: Identify the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.
2. Identification of the infringing material: Identify the material you claim is infringing and provide sufficient information for us to locate it (e.g., the URL of the page containing the material, the ad ID number, or a description of where the content appears).
3. Your contact information: Provide your full legal name, mailing address, telephone number, and email address.
4. Good faith statement: Include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. Accuracy statement: Include a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
6. Signature: Include your physical or electronic signature.

5. How We Respond to Takedown Notices

Upon receiving a valid DMCA takedown notice that complies with the requirements above, we will:

1. Acknowledge receipt of the notice within 2 business days.
2. Review the notice for completeness and validity.
3. If the notice is valid, promptly remove or disable access to the identified material, typically within 5 business days of receiving the notice.
4. Notify the user who posted or is associated with the removed material (if applicable) and provide them with a copy of the takedown notice.
5. Preserve a record of the notice and our response for our files.

Incomplete notices: If your notice is missing required elements, we will attempt to contact you for clarification. However, incomplete notices may not be actionable under the DMCA, and we are not obligated to act on them.

6. Counter-Notification

If you believe that material removed from Digital Ad Archive was not infringing, or that you have authorization from the copyright owner or the law to use the material, you may file a counter-notification with our Designated Agent. Your counter-notification must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location where it appeared before removal.
3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number.
5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the District of Nevada), and that you will accept service of process from the person who filed the original takedown notice.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we will restore the removed material.

7. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), Digital Ad Archive maintains a policy for the termination of users who are repeat infringers of copyright in appropriate circumstances. Users who repeatedly upload infringing content or are the subject of multiple valid DMCA takedown notices may have their accounts suspended or permanently terminated at our sole discretion.

8. Misrepresentation Warning

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing — or that material was removed or disabled by mistake or misidentification — may be subject to liability for damages, including costs and attorneys’ fees.

Before filing a DMCA notice, please carefully consider whether the use of the material at issue constitutes fair use. If you are unsure whether the material you are reporting infringes your copyright, you may wish to contact an attorney before filing a notice.

9. Modifications to This Policy

Digital Ad Archive reserves the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to this page. Your continued use of the platform after any modification constitutes acceptance of the updated policy.
